SCOPE 1.1 The Service Provider: the owner and operator of the Internet pages (hereinafter referred to as the "Website") is Macma Kft.(company registration number: registered office:Str. Fáy 2, 1184 Budapest, Ungaria), hereinafter referred to as the "Service Provider". 1.2 The User: the use of the Website operated by the Service Provider is subject to the User's prior reading and acceptance of the terms and conditions stated in this document. By accessing the Website operated by the Service Provider, the User acknowledges that he/she has read and understood these Terms of Service and accepts its provisions as binding upon him/her. 1.3 The Website: all Websites operated by the Service Provider under a domain name registered in the Service Provider's name are subject to these Terms of Service. The Service Provider's Website, in particular the websites macma.ro and all their sub-pages, may be freely browsed by anyone, subject to the provisions of these Terms of Service. The Service Provider may, however, make the use of certain websites or services available from the websites subject to prior registration (in particular in the case of the Webshop). 2. CONDITIONS OF USE Anyone may use a link to the pages of the Service Provider, but the manner and scope of use must not violate the conditions set out in Section 3 of these Terms of Service; The creation of a frame around the content of the Website is prohibited; False representation of affiliation with the Service Provider; You may not publish false information about the Service Provider's products or services; Use of the Service Provider's logo or trademarks is subject to prior permission; No distasteful or offensive content. 3. CONTENT AND INTELLECTUAL PROPERTY RIGHTS The image, the compilation, arrangement, editing and the content of the Service Provider's Website, as well as the content itself (hereinafter referred to as the "Content") are protected by copyright due to their individual, original nature. The copyright holder is the Service Provider (section 1.1), and therefore only the Service Provider is entitled to authorise any use by others. The Content may not be reproduced, copied, republished, distributed or stored in any form in whole or in part without the prior written permission of the Service Provider. It is also prohibited to create, adapt or modify any material or works of any kind, including but not limited to fonts, icons, buttons, links, wallpapers, screensavers, text, images, graphics, logos, postcards, photographs, audio and video materials, arising from or based on the Content, or to distribute or sell them without authorisation. Any commercial use requires the prior written consent of the Service Provider. The User must respect all copyright and other rights in the Content. The Service Provider may modify, update or withdraw all or part of the Content at any time without prior notice. Copyright infringement may have civil (Article 94 of Act LXXVI of 1999 on Copyright) and criminal (Article 329/A of the Criminal Code) consequences. 4. LIABILITY OF THE SERVICE PROVIDER The Service Provider cannot be held liable for the accuracy, reliability and completeness of the Content, given that it may be subject to changes independent of the Service Provider, but it will do its utmost to ensure the integrity of the Content. Users use the Site solely at their own risk and the Service Provider shall not be liable for any damage resulting from incorrect, erroneous or incomplete Content. The Service Provider shall place links to content and Internet pages placed by third parties accessible from its own Website, but shall not be liable for any content and Internet pages placed by third parties and shall not be liable for any damage resulting from the use of the content of such pages. The User acknowledges that the Service Provider shall not be liable for any error in the User's computer, damage caused by a virus or any loss of data, or unauthorised access to the User's computer or network. 5. PROTECTING THE SECURITY OF THE SERVICE PROVIDER'S WEBSITE Users must not breach or attempt to breach the security of the Website, in particular: accessing data not intended for the User or logging on to a server or identifier to which the User is not entitled; attempt to probe, spy or test the vulnerability of the system or network, or breach system security or access control measures without proper authorisation; attempting to interfere with or disrupt the services provided to any User, host or network (in particular: placing viruses on the Website, overloading, flooding, spamming, mailbombing or crashing the Website); sending unsolicited e-mails, including the promotion and/or advertising of products or services. 6. CHANGES TO THE TERMS OF SERVICE The Service Provider may amend these Terms of Service at any time. The User acknowledges and accepts, by registering as set out in Section 3, that he/she shall be bound by any amendments to the Terms of Service. 7. REGISTRATION CONDITIONS If the visit of a Website or the services available on it requires registration, the User, by filling in the Registration Data Sheet, accepts and is bound by these Terms of Service and at the same time agrees to the processing of the User's personal and company data by the Service Provider in accordance with the Privacy Policy. By completing the registration form, the User gives his/her consent to the processing of his/her personal data by the Service Provider for the purposes set out in these Terms of Service. By approving the registration, the User acknowledges that the above consent is given as a voluntary informed declaration. In the light of the present Terms of Service, the User may decide which data, in addition to those required for registration, he/she wishes to provide to the Service Provider on the Website. At the same time, by providing his/her data, he/she authorises the Service Provider to use his/her personal data in accordance with these Terms of Service. Please note that your data provision is voluntary in all cases. The User is obliged to: provide accurate and complete information on the questions of the Registration Data Sheet during registration; update the registration data in case of changes. In the event of untruthfulness, incompleteness or inaccuracy of the data provided by the User, the Service Provider has the right to suspend or terminate the User's access, in whole or in part. The Service Provider reserves the right, at any time and at its sole discretion, to immediately terminate the User's right to use and access the Website if the User breaches these Terms of Service or any applicable law. 8. GOVERNING LAWS, DISPUTES In preparing these Terms and Conditions of Use, the Service Provider has acted in accordance with the applicable Hungarian legislation and the Hungarian legislation shall prevail in respect of any matters not regulated herein. Any disputes arising from the application of these Terms of Use and which cannot be settled out of court shall be settled before the Hungarian courts having jurisdiction and venue.
